<p><br /><strong><strong>Backdating Purchase Agreements for Home Buyer Tax Credits = Criminal Fraud </strong></strong><br /><em><em>by Shelley R. McCoy and John Q. Herrin</em></em><br /><br />As a reminder, the <a href="http://www.mlsindy.com/redir.aspx?C=b77379ef3b1f445db81af439038c9595&amp;URL=http%3a%2f%2fwww.news.mibor.com%2fl.jsp%3fd%3d527.78527.781.4t90jeg..A" target="_blank"><strong>Home Buyer Tax Credits</strong></a> are set to expire April 30, 2010. This means that buyers who wish to benefit from the tax credit must have an accepted binding purchase agreement as of that date. <br /><br />With the tax credit deadline looming, however, home buyers or REALTORS&reg; may be tempted to backdate post-April 30th purchase agreements. REALTORS&reg; must resist this temptation or face severe criminal consequences. <br /><br />Specifically, Title 26, Section 7206 of the United States Code, warns that any person who aids or assists in a fraudulent or false document in connection with any matter under the Internal Revenue laws is guilty of a felony and subject to:</p>
<p>(1) Imprisonment for not more than 3 years in a Federal prison;<br />&nbsp;</p>
<p>(2) A fine of $250,000 for individuals or $500,000 for corporations; or<br />&nbsp;</p>
<p>(3) Both</p>
<p><br />In fact, just last week, a Los Angeles REALTOR&reg; pleaded guilty to federal tax charges after she helped&nbsp;five&nbsp;new home buyers fraudulently obtain the $8,000 credit. She also assisted&nbsp;five others in scamming the IRS under the Earned Income Tax Credit. As a result, the REALTOR&reg; faces up to 50 years in prison and a $2.5 million fine. <br /><br />Like the fraudulent LA REALTOR&reg;, any Indiana REALTOR&reg; who backdates a post-April 30th purchase agreement will be guilty of criminal tax fraud and subject to a lengthy prison term and pricey fine.<br /><br />So, think before you backdate a purchase agreement: Is committing criminal fraud for an $8,000 or $6,500 tax credit worth risking your career, a prison sentence, and fine? Do not let a misguided desire to help your client ruin your life. <p>A short sale can be an solution for homeowners who need to sell, and who owe more on their homes than they are worth.</p>
<p>In the past, it was rare for a bank or lender to accept a short sale. Today, however, due to market changes, banks and lenders have become much more negotiable when it comes to these transactions. Recent changes have also improved the chances of getting a short sale approved.<br /><br />But to be technical, here's a more official definition:</p>
<ul class="bulleted">
<li>A homeowner is 'short' when the amount owed on his/her property is higher than current market value.</li>
<li>A short sale occurs when a negotiation is entered into with the homeowner's <a id="GVLINK_1_0_1" class="GVAdLink" href="http://www.mlsindy.com/#">mortgage company</a> (or companies) to accept less than the full balance of the loan at closing. A buyer closes on the property, and the property is then 'sold short' of the total value of the mortgage.</li>
</ul>
<p>For Homeowners to qualify for a short sale, they must fall into all of the following circumstances:</p>
<ul class="bulleted">
<li><span style="text-decoration: underline;"><strong><a id="GVLINK_2_0_0" class="GVAdLink" href="http://www.mlsindy.com/#">Financial Hardship</a></strong></span> &ndash; There is a situation causing you to have trouble affording your mortgage.</li>
<li><strong><span style="text-decoration: underline;">Monthly Income Shortfall</span></strong> &ndash; In other words: "You have more month than money." A lender will want to see that you cannot afford, or soon will not be able to afford your mortgage.</li>
<li><strong><span style="text-decoration: underline;"><a id="GVLINK_3_0_2" class="GVAdLink" href="http://www.mlsindy.com/#">Insolvency</a></span></strong> &ndash; The lender will want to see that you do not have significant liquid assets that would allow you to pay down your mortgage.</li>
</ul>
